1. Acceptance of Terms
These Terms of Service (“Terms”) govern your use of the catering services provided by Swagat Caterers (“Swagat”, “we”, “our”). By booking our services, submitting an enquiry, or engaging us for any event, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our services.
Swagat Caterers is operated from AA-04, Tulsi Nagar, Near RR Avenue, Indore 452010, Madhya Pradesh, India. We provide pure vegetarian catering services for weddings, corporate events, social gatherings, and private celebrations.
2. Booking and Confirmation
- Enquiry: All catering bookings begin with an enquiry via phone, WhatsApp, email, or our website contact form. We respond to enquiries within 24 hours.
- Menu Finalisation: Following the initial enquiry, we provide a customised menu proposal and quotation. The menu must be finalised at least 7 days before the event date for events up to 200 guests, and 15 days before for events above 200 guests.
- Confirmation: A booking is considered confirmed only after the advance payment is received and a written confirmation (email or WhatsApp) is sent by Swagat Caterers. Verbal discussions or preliminary quotations do not constitute a confirmed booking.
- Guest Count: The final guest count must be communicated at least 48 hours before the event. Catering will be prepared for the final count provided, plus a 5% buffer. If the actual guest count exceeds the final count by more than 5%, additional charges may apply at the prevailing rate.
3. Pricing and Payment
- Quotation: All quotations are valid for 30 days from the date of issue. Prices are subject to change after this period.
- Advance Payment: A non-refundable advance of 25% of the total estimated amount is required to confirm the booking. The booking will not be held without the advance payment.
- Final Payment: The remaining balance (adjusted for any final guest count changes) must be settled on or before the day of the event, unless otherwise agreed in writing.
- Payment Methods: We accept bank transfers (NEFT/RTGS/IMPS), UPI, and cheques drawn in favour of Swagat Caterers. Cash payments are accepted up to the limits prescribed under Indian tax law.
- Taxes: All prices are exclusive of applicable taxes (GST). GST at the prevailing rate will be added to the final invoice as per Indian tax regulations.
- Additional Charges: Any additional services requested after confirmation (extra live counters, additional cuisine, extended service hours, decoration changes) will be charged separately and must be agreed upon in writing before the event.
4. Cancellation Policy
If you need to cancel your booking, the following cancellation charges apply:
- More than 30 days before event: 25% of the advance payment is forfeited. The remaining advance (75%) is refunded within 15 working days.
- 15–30 days before event: 50% of the advance payment is forfeited. The remaining advance (50%) is refunded within 15 working days.
- 7–14 days before event: The entire advance payment is forfeited. No refund is applicable.
- Less than 7 days before event: 50% of the total estimated billing amount becomes payable, in addition to the forfeited advance.
Cancellations must be communicated in writing (email or WhatsApp). Phone cancellations will not be considered valid until confirmed in writing.
In the event of cancellation by Swagat Caterers (due to circumstances beyond our control), the full advance payment will be refunded within 15 working days, and no further liability will rest with Swagat Caterers.
5. Postponement and Rescheduling
If you wish to postpone or reschedule your event, the following conditions apply:
- Rescheduling requests must be made at least 7 days before the original event date.
- The new date is subject to availability. If the new date is available, the advance payment will be adjusted to the rescheduled event without any penalty.
- If the new date is not available within 90 days of the original date, the cancellation policy (Section 4) will apply.
- If rescheduling is requested less than 7 days before the event, a rescheduling fee of 10% of the estimated amount will apply.
6. Service Conditions
- Pure Vegetarian Policy: All food prepared by Swagat Caterers is strictly pure vegetarian. We do not prepare, store, or serve any non-vegetarian food items. We reserve the right to refuse service if non-vegetarian food from external sources is served at the same event without prior agreement.
- Venue Requirements: The client must provide adequate kitchen space, water supply, and electricity at the venue. If the venue lacks basic amenities, additional charges for generators, water tankers, or temporary kitchen setup may apply.
- Service Time: Standard service time is 4 hours from the agreed start time. Extended service hours are chargeable at the prevailing rate.
- Dietary Preferences: Jain, no-onion-no-garlic, and other dietary preferences must be communicated at the time of menu finalisation. Last-minute changes (within 48 hours) may not be accommodated.
- Food Quality: We maintain the highest standards of food quality and hygiene. However, once food is served at the venue, Swagat Caterers is not liable for any issues arising from improper handling, storage, or reheating by third parties.
- Leftover Food: Leftover food may be taken by the client or distributed as per their instructions. Swagat Caterers is not responsible for any health issues arising from the consumption of leftover food after it has left our service area.
7. Force Majeure
Swagat Caterers shall not be liable for any failure or delay in performance of services caused by circumstances beyond our reasonable control, including but not limited to natural disasters, floods, fires, pandemics, government restrictions, civil unrest, strikes, transportation disruptions, or any other event of force majeure. In such cases, we will work with you to reschedule the event or provide a refund of the advance payment, at our discretion.
8. Limitation of Liability
Swagat Caterers’ total liability for any claim arising from our catering services shall not exceed the total amount paid by the client for the specific event in question. We are not liable for indirect, consequential, or incidental damages, including but not limited to loss of reputation, emotional distress, or business losses.
Any complaints regarding food quality or service must be reported within 24 hours of the event. Reports made after this period may not be eligible for compensation or adjustment.
9. Intellectual Property
All content on our website, including text, images, menus, logos, and design elements, is the property of Swagat Caterers and may not be copied, reproduced, or used without our written permission. Photographs taken by our “Capturing Moments” photography team remain the intellectual property of Swagat Caterers unless a separate photography agreement states otherwise.
Swagat Caterers may use photographs from your event (including food, decor, and setup — not personal guest photos) for marketing and portfolio purposes unless you explicitly opt out in writing at the time of booking.
10. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising from these Terms or our catering services shall be subject to the exclusive jurisdiction of the courts in Indore, Madhya Pradesh.
We encourage amicable resolution of all disputes. Before initiating legal proceedings, we request that you contact us in writing with your concern, and we will respond within 15 working days with a proposed resolution.
11. Changes to Terms
We reserve the right to modify these Terms of Service at any time. Updated Terms will be posted on this page with a revised date. Bookings made before the update will be governed by the Terms in effect at the time of booking confirmation.
